Growing a Patina after sale on eBay

A very interesting pair of eBay Auctions.
On 2003 November 30th Mike Epstein posted a report on CFDL a coin with a fake acid patina which was on auction on eBay. This is not a rare occurrence, except for the fact that feedback had clues to identify the ebay Auction at which this unmistakably the same replica coin had been won by seller on 2003 September 7th.

I assume that could be clearly understood as being sold as obvious Fake.

xromantik as Buyer gave seller negative feedback on 2003 Sept 20th :

Complaint : Sold a copied coin does not react to mails, goes it not!

The seller retaliated to the buyer's negative feedback on 2003 Nov 11th:
Complaint : Achtung vor diesem E-Bayer!!Hier droht Betrug!!Vorsicht !! Vorsicht!! nie wieder

The buyer has clearly taken the joke too far in his attempt to recover his losses. Although he recovered double of his bad investment, he probably ruined any reputation he may have had as a seller.

Wasn't it obvious to first buyer from image that it was a replica.
Anyone can see that and the seller even joked about it.
Why didn't seller offer buyer a refund since he shouldn't have listed it without an explicit statement that it was a replica.
